1. Introduction

At TMI CONTAINERS SL, we are committed to your satisfaction. This Return Policy explains your rights regarding returns, exchanges, and refunds when purchasing products from our website, in accordance with EU Directive 2011/83/EU and Spanish consumer protection law (Real Decreto Legislativo 1/2007).

2. Right of Withdrawal

In accordance with EU Directive 2011/83/EU, you have the right to withdraw from your purchase within 14 calendar days from the date of delivery, without giving any reason.

To exercise this right, you must notify us of your decision by sending a clear written statement (e.g., by email or postal mail) before the withdrawal period expires.

Upon receiving your withdrawal notice, we will refund all payments received, including the initial delivery costs (except for supplementary costs if you chose a delivery method other than the least expensive standard delivery offered), within 14 days.

3. Extended Return Window

Beyond the 14-day legal withdrawal period, TMI CONTAINERS SL offers a total return window of 30 calendar days from the date of delivery for standard catalog products, provided they are in their original, unused condition.

4. Exceptions to the Right of Withdrawal

In accordance with Article 16 of EU Directive 2011/83/EU, the right of withdrawal does not apply to the following:

• Products made to your specifications or clearly personalized (custom-built containers, modified containers with bespoke configurations, custom modular homes).
• Products that have been installed, assembled, or permanently modified after delivery.

Custom-made products are clearly identified as such on their product page before purchase. For these products, the 2-year legal guarantee for defects still applies.

5. Return Conditions

For a return to be accepted, the following conditions must be met:

• The product must be in its original condition, without structural modifications or damage caused after delivery.
• All original accessories, documentation, and packaging must be included when applicable.
• The return request must be submitted within the applicable return window (14 or 30 days from delivery).

6. Return Shipping and Collection Costs

Due to the size and weight of our products (shipping containers, modular structures), return shipping requires specialized logistics (crane, flatbed truck transport). The direct costs of returning the goods are borne by the customer, unless the product is defective or does not match the description provided.

Before confirming your return, we will provide you with an estimated cost for the collection and transport of the product based on your location. This estimate will be communicated before you finalize the return so you can make an informed decision.

7. Defective or Non-Conforming Products

If you receive a product that is defective, damaged during transport, or does not match the description on our website, you have the right to:

• A free repair of the product.
• A free replacement with an identical or equivalent product.
• A price reduction proportional to the defect.
• A full refund if the above options are not viable.

In the case of defective or non-conforming products, all return and collection costs are borne by TMI CONTAINERS SL.

8. Legal Guarantee (2 Years)

All products sold on our website are covered by the minimum 2-year legal guarantee as required by EU consumer protection law. This guarantee covers defects in conformity that become apparent within 2 years of delivery.

The legal guarantee does not cover damage caused by misuse, improper installation, lack of maintenance, normal wear and tear, or external factors such as adverse weather conditions.

9. Refund Process

Once your return is received and inspected, we will notify you of the approval or rejection of your refund.

• Approved refunds are processed within 14 business days.
• Refunds are issued to the original payment method used for the purchase.
• We may withhold the refund until we have received the returned product or you have provided proof of shipment, whichever comes first.

10. How to Request a Return

To initiate a return, please follow these steps:

1. Contact our customer service by email or phone to notify us of your intention to return the product.
2. Provide your order reference number, the product concerned, and the reason for the return.
3. Our team will confirm your return request and provide instructions for the collection or shipment of the product, along with a cost estimate for return logistics.
4. Once the product is received and inspected, we will process your refund or exchange.
